Terms and Conditions License

Conditions for Issue of Licence under the Ports (Issue of Licences) Regulations, 1981

1. Applications for licence under the Ports (Issue of Licences) Regulations, 1981 must be made on prescribed forms obtainable from the Director Port Operations, Mauritius Ports Authority, Mer Rouge, Port Louis or downloaded from MPA website.

2.   The following documents should be submitted in support of an application for a port licence:-

  • Articles and Memorandum of Association OR Constitution of the company.

  • Certificate of Incorporation of the company.

  • Company`s Licence for the current year (receipt of the Registrar of Companies).

  • Trade Licence issued by a recognized body (Municipal Council or District Council)

  • Letter from the principal appointing the company to do business on his part or with him.

  • Job Contractor’s permit issued by the Ministry of Labour (if applicable).

  • Any other relevant document that may bring support to the application and any additional information as may be required by the Authority such as a business plan.

  • A letter from port based companies (where applicable).

  • The Shareholding Structure of the Company as certified by the Registrar of Companies, including copies of the ID of its Shareholders and Directors, at the time of application.

  • Letter of application on letterhead of the company should be addressed to the Director General of the Mauritius Ports Authority.  

3. Applicants shall undertake to supply any additional information, clarification or explanation as may be required by the Mauritius Ports Authority for the purpose of the application. Where charges and fees are not subject to Government's approval, the applicant may be required to submit a copy of his latest audited accounts. Furthermore, every Applicant shall be required to furnish a bank guarantee (where applicable), the amount of which will be determined by the Authority.

4. The Issue of a port licence under the above Regulations does not relieve the Applicant from his obligation to comply with other provisions of the laws in force in Mauritius, including safety, security and environmental aspects pertaining to the port. Any port licence granted by the Authority may be subject to such other terms and conditions, as may be imposed at the time of issue or renewal of the licence, or during the currency thereof. 

5. The Licensee shall be responsible for all damages caused to the Authority's goods or property as a result of his or his agent's acts or negligence, improper supervision, etc. All such claims would be directed to the Licensee for all settlement.

6. The loss of the port licence must be reported immediately to the MPA and the Police.

7. The port licence must be surrendered to the Authority if the applicant ceases to perform the business for which such licence has been issued. The port licence is not transferable.

RENEWAL OF LICENCES

8. Applications for the renewal of port licences should be submitted at least two months before the expiry date. If application for renewal of a Port Licence is not made within two months of the expiry date of the licence, it would be assumed that the Port Licensee is no more interested to carry out its activity.

9. Access to the Port Area will be denied to those who have not renewed their port licences.
